Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your use of the mobile application SimilarTo: TV Series & Movies (the "App") and the website similartvmovies.com (the "Site", together the "Service").

The Service is developed and operated by an independent individual developer ("I", "me", "the developer") — not a company. You can contact me at vladyslavmorozovwork@gmail.com.

By downloading, installing or using the App you agree to these Terms. If you do not agree, please do not use the Service.

2. Scope and Apple's EULA

The App is distributed exclusively through the Apple App Store for iPhone. These Terms apply alongside Apple's standard Licensed Application End User License Agreement. Apple is not a party to these Terms and is not responsible for the App or its content; however, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

3. License

You are granted a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for personal, non-commercial purposes, in accordance with these Terms and the App Store Terms of Service.

4. Subscriptions (PRO)

The App offers optional auto-renewable subscriptions ("PRO") that unlock premium functionality. The following applies to all PRO subscriptions:

• Available plans: weekly, monthly and yearly. Prices are shown in the App before purchase and may vary by region.
• A free trial may be offered (currently attached to the monthly plan). If you do not cancel before the trial ends, the subscription starts automatically and your Apple ID is charged.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel subscriptions at any time in your device settings: Settings → Apple ID → Subscriptions, or via the App Store app. Deleting the App does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple in accordance with App Store policies. I cannot issue refunds directly for purchases made through the App Store; you can request a refund from Apple at reportaproblem.apple.com.

5. Credits ("Tickets")

The App uses virtual credits (sometimes called "tickets") that can be spent to generate AI recommendations. Credits may be earned by watching rewarded advertisements or granted by the App.

• Credits are a limited, revocable, non-transferable license to access a feature of the App. They are not money, have no cash value and cannot be exchanged, sold or refunded.
• Credit balances are associated with an anonymous device identifier. Reinstalling the App or changing devices may reset your balance.
• I reserve the right to change how credits are earned, spent or expire, or to discontinue the credit system.

6. Advertising

The App displays third-party advertisements served by Google AdMob, including interstitial ads and optional rewarded ads. Ad content is provided by third parties and I am not responsible for it. See the Privacy Policy for details on advertising and tracking.

7. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• reverse engineer, decompile, modify or create derivative works of the App, except where such restriction is prohibited by law;
• access the Service or its backend through automated means (bots, scrapers) or attempt to bypass its technical or security measures;
• abuse, overload or disrupt the Service, including the recommendation and credits systems;
• resell or commercially exploit the Service or its content.

8. Intellectual property and content

The App's branding, design and software are owned by the developer. All movie and TV series titles, metadata, descriptions, posters and artwork displayed in the Service belong to their respective rights holders and are shown for informational purposes.

This product uses the TMDB API but is not endorsed or certified by TMDB.

Recommendations shown in the App are generated with the help of artificial intelligence and are provided for entertainment and informational purposes only. They may occasionally be inaccurate or incomplete.

9. Content removal requests by rights holders

To help process a request quickly, please include:

• identification of the work claimed to be infringed;
• identification of the material to be removed (e.g. title, screenshots, where it appears in the Service);
• your contact information and a statement that you are the rights owner or authorized to act on their behalf.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. I do not warrant that the Service will be uninterrupted, error-free or that recommendations will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or profits, arising out of or related to your use of the Service. In any case, total aggregate liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the statutory rights you hold as a consumer.

12. Termination

You may stop using the Service at any time by deleting the App. I may suspend or terminate access to the Service (including the credits system) if you materially breach these Terms or if the Service is discontinued. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) survive.

13. Changes to these Terms

I may update these Terms from time to time. The current version is always available at similartvmovies.com/terms with its effective date at the top. Material changes will be reflected by updating the effective date; continued use of the Service after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws applicable in the developer's country of residence, without regard to conflict-of-law rules, except where the mandatory consumer-protection laws of your country of residence provide otherwise.
